Potluck supplies all food donors with convenient, disposable aluminum food containers free of charge. How Food Donors are Protected from Liability The “Bill Emerson Good Samaritan Act” (Public Law 104-210) protects food donors from liability when donating food in good faith to nonprofit organizations feeding the hungry. The act is designed to encourage the donation of prepared, perishable and frozen food and grocery products to nonprofit organizations like Potluck. Tax Benefits for Donating Food The general rule since 1969 states that a taxpayer who donates food to a nonprofit organization can deduct the amount of their cost in the food donated – as opposed to its fair market value.
