How Food Donors are Protected from Liability


The “Bill Emerson Good Samaritan Act” (Public Law 104-210) protects food donors from liability when donating food in good faith to nonprofit organizations feeding the hungry. The act is designed to encourage the donation of prepared, perishable and frozen food and grocery products to nonprofit organizations like Potluck.

The Act states that nonprofit organizations and businesses shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of apparently wholesale food or grocery products received as donations.

Here in Arkansas, our State Good Samaritan statues also provide protection to donors in addition to the Bill Emerson Good Samaritan Act.

Also, Potluck asks all recipients to sign an agreement accepting food ‘as is”, which further limits liability.



Tax Benefits for Donating Food


The general rule since 1969 states that a taxpayer who donates food to a nonprofit organization can deduct the amount of their cost in the food donated – as opposed to its fair market value. (Consult with your tax advisor in applying the appropriate deduction.)

*Most all prepared food has been frozen prior to pick-up. We do not accept any products that contain alcohol.
